A decision may be binding, persuasive, or irrelevant depending on the court and jurisdiction. Research should identify the controlling court system before relying on a case.

Read beyond the headline

Summaries and snippets can hide important limits. The holding, procedural posture, standard of review, factual distinctions, and later treatment of the case may all matter.

Compare facts and legal issues

Two cases can discuss the same doctrine but reach different results because the facts are different. Good research identifies which factual differences the court considered legally important.

Check current validity

Later cases, legislation, rule changes, or higher-court decisions can limit or overrule older authority. Important cases should be checked for current treatment before being relied upon.
